General Terms and Conditions

General Information
All services provided by the online store pa-so.swiss to the customer are based solely on the following General Terms and Conditions. Deviations are only valid if agreed upon in writing between the online store pa-so.swiss and the customer.

Contract Conclusion

1. The offers of the online store pa-so.swiss on the internet constitute a non-binding invitation for the customer to place an order on the pa-so.swiss website.

2. By placing an order for the desired goods on the internet, the customer concludes a valid purchase contract.

3. The online store pa-so.swiss has the right to reject this contract within 3 calendar days.

Delivery Times
All items will be delivered immediately, provided they are in stock.
Delivery is possible both within Switzerland and to EU countries.
The delivery time within Switzerland for in-stock items is a maximum of 5 business days.
For international deliveries, the delivery time for in-stock items is generally up to 10 business days.
Some items may have a longer delivery time (e.g., items that are specifically ordered for you).
If an item is temporarily unavailable, we will notify you via email about the expected delivery time, provided we have your contact details.
No compensation can be claimed for delivery delays caused by force majeure, traffic disruptions, orders from higher authorities, or other events beyond our control.

Packaging and Shipping Costs
For delivery within Switzerland and packaging costs, we charge a flat rate for orders up to CHF 300.-.
For orders over CHF 600.-, delivery is free of charge within Switzerland.
For international deliveries, packaging and shipping costs will be calculated in agreement with the buyer.
For orders exceeding CHF 600.-, delivery within Switzerland is free of charge (excluding items that cannot be shipped as parcels).
International deliveries do not qualify for free shipping for orders over CHF 600.-.
Express delivery can be arranged at additional costs depending on the courier service.

Payment
All prices are final prices.
We deliver against prepayment and cash payment (or with credit card online).
When paying in advance, you will receive an email with the exact invoice details. Please ensure that you provide your email address and/or phone number in the order form so we can contact you. Please include your name and invoice number as the reference when making a payment so that we can match your payment to your order.
The delivered goods remain our property until full payment is made. In case of exceeding the agreed payment deadlines, reminder and processing fees will be charged.

Right of Withdrawal and Consequences of Withdrawal
Right of Withdrawal:
You may cancel your contract within 24 hours by phone or email. The withdrawal period starts when your order is received in our shop system.

Consequences of Withdrawal:
In the event of a valid withdrawal, both parties must return the received goods and, if applicable, return any benefits (e.g., interest). If you cannot return the goods in full or in a deteriorated condition, you may have to provide compensation for the reduced value.
This does not apply to goods if their deterioration is solely due to the examination (e.g., as you would be able to do in a retail store). Additionally, you can avoid compensation by not using the item as an owner and refraining from anything that may impair its value.
For returns from a product delivery, you must bear the cost of returning the goods if the delivered goods correspond to the order. Otherwise, the return is free of charge.

Exchange / Return
The return or exchange of items due to dissatisfaction is excluded. Returns and cancellations after the withdrawal period will incur a processing fee of 10% of the value of the goods, but at least CHF 20.-. This does not apply to defective deliveries due to the fault of pa-so.swiss & pa-so native art gmbh.

Warranty
Upon delivery to the carrier, the risk passes to the buyer. If any transport damage to the goods is discovered, the recipient must immediately report the damage to the carrier (shipping service). Other noticeable transport damages must be reported to us in writing no later than 7 days after receiving the goods.
We are not liable for defects caused by improper handling, normal wear, or external influences. If repairs are carried out by the buyer or a third party without our written consent, the warranty claim is void.

Liability Limitation
Unless otherwise specified below, further claims by the customer, for whatever legal reason, are excluded. The online store pa-so.swiss is not liable for damages that are not caused to the delivery item itself; in particular, it is not liable for lost profits or other financial damages to the customer.
If the contractual liability of pa-so.swiss is excluded or limited, this also applies to the personal liability of employees, representatives, and agents. This liability limitation does not apply if the cause of damage is due to intent or gross negligence or if personal injury occurs. It also does not apply if the customer makes legally regulated claims.
The provisions of the Product Liability Act remain unaffected.
If pa-so.swiss negligently violates an essential contractual obligation, the liability for property damage is limited to the typical damage expected to occur.

If replacement delivery occurs as a subsequent performance, the buyer is obligated to return the originally delivered goods within 30 days to the online store pa-so.swiss at its own cost.
The return of defective goods must be made in accordance with legal regulations. The online store pa-so.swiss reserves the right to claim damages under the legally regulated conditions.
The limitation period is two years, starting from the delivery of the goods.

Data Protection
The data you provide will be used solely for processing your orders. All your data will be treated strictly confidential. Data will only be passed on to third parties (e.g., shipping services) if necessary for order processing.
Order data is transmitted securely, but we do not assume liability for the security of data during transmission over the internet (e.g., due to technical issues with the provider) or for potential criminal access by third parties to files on our website.
Login details for customer accounts, provided upon request, must be kept confidential by the customer, as we do not take responsibility for the use and handling of this data.

All photos, logos, texts, reports, scripts, and programming routines displayed on these pages, which are developed by us or prepared by us, may not be copied or used otherwise without our consent. All rights reserved.

Miscellaneous
We have no influence if items are discontinued by our suppliers and are therefore no longer available or changed in type and design. If a replacement item is offered by the supplier, we will inform you. No compensation claim can be made for items that are no longer available. We reserve the right to change the prices of individual items.

Validity of the Terms and Conditions
By placing an order, the General Terms and Conditions of the online store pa-so.swiss are accepted. If any provision of these Terms and Conditions is invalid for any reason, the validity of the remaining provisions shall not be affected. Oral agreements must be confirmed in writing. The place of performance and jurisdiction is, unless otherwise legally specified, the competent court at the registered office of pa-so native art gmbh & pa-so.swiss, Harold Widmann.

Court of Jurisdiction
The competent court at the registered office of pa-so.swiss, Harold Widmann, is the exclusive jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
